Abstract
At present, technological developments are increasingly developing and increasingly sophisticated, so that everything becomes easier, especially the problem of buying and selling online, even in the implementation of buying and selling, as in Shopee, the modern business model does not present business actors physically and does not use original signatures when This is starting to be of interest to the public, thus it must have guidelines for the implementation of transactions which are allowed and the implementation of transactions that are not allowed, so the main issues discussed by this study are the first, how is the implementation of Shopee online buying and selling transactions and second, how is the selling and selling Buy Shopee online according to Law No. 19 of 2016 on information and electronic transactions and Fatwa DSN MUI No. 110 / DSN- MUI / IX / 2017 on the implementation of online buying and selling transactions at Shopee. . The methodology used by researchers is a qualitative method, the type of research is juridical normative, whose activities include searching for literature, journals and previous researchers related to the problem to be studied by collecting data from journals and previous research that will be researched, using primary data sources obtained from literature review, in the form of regulations and Fatwa DSN-MUI No: 110 / DSN-MUI / IX / 2017 concerning buying and selling and secondary data related to books on online buying and selling transactions . The results of this study indicate that the implementation of Shopee's online buying and selling is in accordance with the principles of the transaction and there is no coercion between the two parties making the transaction. The transaction method is because the buyer makes payments and the seller sends the goods even though with COD (Cash On Delivery) the seller can send the goods or products with the buyer according to the registered address. Consent and qabul to Shopee are carried out by mentioning the nature and clearly mentioning the physical characteristics or photos of the items being sold, so as not to cause the prospective buyers' ignorance of the items purchased. Then the implementation of transactions at Shopee is not entirely in accordance with Law No. 19 of 2016 concerning ITE and Fatwa DSN-MUI No: 110 / DSN-MUI / IX / 2017, especially for goods and products that still contain haram elements, there is no halal label on goods goods that are allowed to be consumed by Muslims and there are also products that exceed restricted and prohibited products.
