Abstract
Marriage and Divorce Permits for Civil Servants are regulated in Article 3 of Government Regulation Number 45 of 1990 concerning Amendments to Government Regulation Number 10 of 1983. Civil Servants who wish to carry out a Divorce must obtain permission or a letter from the official in advance. However, the decision on case No.1800/Pdt.G/2020/PA.Plg the panel of judges provided an opportunity for the Petitioner to obtain a permit from an authorized official with a grace period of 6 months. In addition, the judge decided to accept and grant the case even though there was no permission from superiors. The purpose of this study is to find out what is the legal basis for judges in deciding and granting divorce cases against civil servants (PNS) without superiors' permission and the urgency of judges to grant divorce cases against civil servants (PNS) without superiors' permission from a maslahah perspective. This study uses research methods in the form of empirical and normative approaches. The results of the study concluded that: (1) Based on legal considerations, the judge granted the lawsuit because the reasons for filing for divorce met the requirements, the statements from the witnesses and the evidence were perfect, the judge granted the lawsuit an attempt to avoid harm for the Plaintiff and the Defendant. (2) If viewed from the maslahah perspective, it can be concluded that درء المفاسد مقدم علي :the judge adheres to the fiqh rule which reads namely "Abandoning Desirability must take precedence جلب المصالح over taking benefit".
