Abstract
ABSTRACT This thesis is entitled Review of Islamic Criminal Law Against Refusal of Payments with Coins According to Law Number 7 of 2011 Concerning Currency, there are two things that are raised to be the focus of research, namely: First, how payments with coins occur. Second, what are the criminal sanctions for payments with coins according to Law Number 7 of 2011 concerning Currency. Third, how is the Islamic criminal law against the payment of coins. The method used in this research is through library research approach (library study). The data source used is secondary data which consists of three parts, namely, primary legal materials, secondary legal materials, and tertiary legal materials. Primary legal materials are binding legal materials in the form of the Qur'an and Hadith, Law Number 7 of 2011 concerning Currency. Secondary legal materials are legal materials that provide explanations of primary legal materials, such as research results and the work of experts, such as theses, journals, and books. Tertiary legal materials are materials that provide instructions or explanations for primary legal materials and secondary legal materials, such as dictionaries, encyclopedias and so on. The data analysis technique used in this study uses qualitative analysis, namely by analyzing data sourced from legal materials based on concepts, theories, laws and regulations, doctrines and legal principles, expert opinions or the views of the researchers themselves. In the results of this study it can be concluded that according to Law Number 7 of 2011 concerning Currency, that is, if the act of refusing payment in Rupiah is subject to a maximum imprisonment of 1 (one) year and a maximum fine of Rp. 200,000,000.00 (two hundred million rupiah).
