Abstract
ABSTRAK Skripsi ini membahas “Faktor-Faktor Penyebab Perceraian Pada Pasangan Baru Menikah Di Kabupaten Garut ( Analisis Putusan Cerai Pengadilan Agampppa Garut Kelas I A Tahun 2021-2022 )”. Dilatarbelakangi penemuan beberapa putusan cerai di Pengadilan Agama Garut mengenai perceraian pasangan baru menikah dan usia pernikahannya belum mencapai satu tahun, dengan beragam faktor. Rumusan masalah (1) Apasajakah faktor-faktor penyebab terjadinya perceraian pada pasangan baru menikah di Kabupaten Garut. (2) Bagaimana pandangan hakim Pengadilan Agama Garut Kelas I A terhadap faktor-faktor penyebab terjadinya perceraian pada pasangan baru menikah di Kabupaten Garut. Teknik pengumpulan data yaitu wawancara, dokumetasi dan kepustakaan. Jenis penelitian yakni penelitian lapangan. Sumber bahan hukum diambil dari primer, sekunder, dan tersier. Teknik analisis data metode deskriptip kualitatif, data bersifat penjelasan, uraian, pendapat, maupun pemaparan terhadap rumusan masalah secara sistematis, factual, dan akurat. Hasil penelitian ini (1) Faktor-faktor penyebab terjadinya perceraian pada pasangan baru menikah di Kabupaten Garut dikarenakan faktor tidak adanya tanggung jawab dan terkendala masalah ekonomi, perjodohan, gangguan dari pihak ketiga, penganiayaan dan juga krisis moral. (2) Pandangan Hakim Pengadilan Agama Garut Kelas I A, apapun faktor penyebab perceraian apabila rumah tangga sudah pecah tidak dapat diselamatkan akan mendatangkan kemudharatan, usia perkawinan tidak mempengaruhi untuk tidak terjadinya perceraian dalam rumah tangga. Kata Kunci : Faktor Penyebab, Pasangan Baru Menikah, Perceraian, ABSTRACT This thesis discusses "Factors Causing Divorce in Newlywed Couples in Garut Regency (Analysis of the Divorce Verdict of the Garut Religious Court Class I A Year 2021-2022)". Against the background of the discovery of several divorce rulings in the Garut Religious Court regarding the divorce of newly married couples and the age of marriage has not reached one year, with various factors. Problem formulation (1) What are the factors that cause divorce in newly married couples in Garut Regency. (2) What is the view of the judge of the Garut Religious Court Class I A on the factors causing divorce in newly married couples in Garut Regency. Data collection techniques are interviews, documentation and literature. The type of research is field research. Sources of legal materials are taken from primary, secondary, and tertiary. Data analysis techniques qualitative descriptive methods, data are explanations, descriptions, opinions, and exposure to problem formulations systematically, factually, and accurately. The results of this study (1) The factors causing divorce in newly married couples in Garut Regency are due to factors of no responsibility and constrained by economic problems, arranged marriages, interference from third parties, persecution and also moral crisis. . (2) The view of the Judge of the Garut Religious Court Class I A, whatever the factor causing divorce if the household has broken cannot be saved will bring prosperity, the age of marriage does not affect the absence of divorce in the household.
