Abstract
Menteri Dalam Negeri Republik Indonesia mengeluarkan Instruksi Menteri Dalam Negeri Republik Indonesia Nomor 6 Tahun 2020 tentang Penegakan Protokol Kesehatan Untuk Pengendalian Penyebaran Corona Virus Disease-2019 atau yang sering disebut dengan istilah Covid-19 yang merupakan suatu wabah pandemi yang sedang melanda umat manusia dibelahan negara di dunia. Penularan virus ini terjadi antar manusia dengan sangat cepat dan meluas. Wabah pandemi ini tidak hanya sangat mempengaruhi aspek kesehatan manusia diseluruh dunia, namun mempengaruhi segala aspek kehidupan sosial, politik, ekonomi, dan bahkan hukum. Dalam Instruksi Mendagri Nomor 6 Tahun 2020 tentang Penegakkan Protokol Kesehatan Untuk Pengendalian Penyebaran Corona Virus Disease-2019, menginstruksikan kepala seluruh Kepala Daerah baik Gubernur, Walikota, dan Bupati agar menegakkan protokol kesehatan secara konsisten untuk mencegah penyebaran Covid-19. Adapun salahsatu yang menjadi sorotan ialah bahwa didalam Instruksi Mendagri itu, terdapat kewenangan Menteri Dalam Negeri untuk memberhentikan Kepala Daerah sebagai sanksi akibat Kepala Daerah dan/ Wakil Kepala Daerah tidak melaksanakan kewajiban sebagaimana Diktum ke-empat yang telah diatur dalam Instruksi Mendagri Nomor 6 Tahun 2020 tentang Penegakkan Protokol Kesehatan Untuk Pengendalian Penyebaran Corona Virus Diseas 2019 yang menyatakan bahwa apabila Kepala Daerah dan Wakil Kepala Daerah tidak menjalankan kewajiban protokol kesehatan maka dianggap telah melanggar kewajiban Kepala Daerah dan Wakil Kepala Daerah sebagaimana telah dijelaskan dalam ketentuan Pasal 67 huruf b Undang-Undang Nomor 23 Tahun 2014 tentang Pemerintahan Daerah. Yakni kewajiban tersebut tentunya mengkoordinir dan menginstruksikan masyarakatnya untuk dapat mencegah penularan wabah Covid-19, hal itu karena salah satu tugas dari Kepala Daerah di Indonesia adalah memelihara ketenteraman dan ketertiban masyarakat. The Minister of Home Affairs of the Republic of Indonesia issued the Instruction of the Minister of Home Affairs of the Republic of Indonesia Number 6 of 2020 concerning Enforcement of Health Protocols to Control the Spread Corona Virus Disease-2019 which is a pandemic outbreak that is sweeping humanity in parts of the world. Transmission of this virus occurs between humans very quickly and widely. This pandemic outbreak not only greatly affects aspects of human health throughout the world, but affects all aspects of social, political, economic and even legal life. In the Minister of Home Affairs Instruction Number 6 of 2020 concerning Enforcement of Health Protocols to control the spread Corona Virus Disease-2019, instruct the heads of all Regional Heads, including Governors, Mayors, and Regents to consistently enforce health protocols to prevent the spread of Covid-19. One of the highlights is that in the Minister of Home Affairs Instruction, there is the authority of the Minister of Home Affairs to dismiss Regional Heads as a sanction due to Regional Heads and/Deputy Regional Heads not carrying out their obligations as referred to in the fourth Dictum which has been stipulated in Minister of Home Affairs Instruction Number 6 of 2020 concerning Enforcement of Health Protocols to control the spread Corona Virus Diseas-2019 which states that if the Regional Head and Deputy Regional Head do not carry out health protocol obligations, they are considered to have violated the obligations of the Regional Head and Deputy Regional Head as explained in the provisions of Article 67 letter b of Law Number 23 of 2014 concerning Regional Government. Namely, the obligation is of course to coordinate and instruct the community to be able to prevent transmission of the plague Covid-19, this is because one of the duties of the Regional Head in Indonesia is to maintain public order and peace.
