Abstract

ABSTRAK Sumpah merupakan pernyataan yang dilakukan oleh seseorang dengan membawa nama Tuhan. Sumpah yang dilakukan atas nama Tuhan tidak boleh dijadikan mainan atau ditempatkan pada hal yang tidak wajar, meskipun dengan tidak sengaja, karena sumpah memiliki konsekuensi kepada orang yang melaksanakan sumpah tersebut. Sumpah menurut hukum Islam merupakan suatu ucapan yang disertai dengan menyebut nama Allah, dengan tujuan meyakinkan pihak lain tentang kebenaran ucapan yang bersumpah. Tujuan penelitian ini adalah (1) untuk dapat mengetahui proses pengangkatan sumpah saksi tanpa menggunakan Al-Qur’an di Pengadilan Agama Garut Kelas IA. (2) untuk mengetahui hukum pengangkatan sumpah saksi yang tidak menggunakan Al-Qur’an. Dalam penelitian ini menggunakan metode jenis penelitian lapangan (field research), yang dalam penelitian jenis ini ialah penelitian kualitatif. Menggunakan sumber data yakni sumber data primer juga sekunder. Kemudian dalam pengumpulan data menggunakan Studi Kepustakaan dan juga wawancara. Dari hasil penelitian dapat di simpulkan bahwa (1) Hakim dalam membuktikan Kesaksian itu benar atau tidak dilakukan dengan pengucapan sumpah. Di Indonesia sumpah Biasanya Menggunakan Al-Qur’an tapi di Pengadilan Agama Garut Kelas IA tidak menggunakan Al-Qur’an mereka cukup mengucapkan Kata “Wallahi”. Pengucapan Sumpah itu dilakukan di hadapan Majelis Hakim dengan mengikuti pengucapan sumpah yang dilakukan oleh Hakim yang bertugas. (2)Tinjauan Hukum Islam Terhadap penggunaan Al-Qur’an itu sebagai sumpah itu Hukumnya Mubah atau boleh. Karena penggunaan Al-Qur’an Tersebut hanya sekedar tradisi yang ada di Pengadilan Di Indonesia.maka Sumpah yang tidak menggunakan Al-Qur’an seperti yang dilakukan di Pengadilan Agama Garut Kelas IA hukumnya boleh karena Anggapan Pengadilan Agama Garut Kelas IA dalam pengucapan sumpah itu cukup dengan pengucapan kata “Wallahi” tanpa menggunakan alat sumpah Al-Qur’an. Kata Kunci: Hukum Sumpah, Pengadilan, Sumpah Saksi ABSTRACT An oath is a declaration made by a person bearing the name of God. Oaths made in the name of God should not be made into toys or placed in unnatural ways, even unintentionally, because oaths have consequences for the person performing the vows. An oath according to Islamic law is a speech accompanied by the invocation of the name of Allah, with the aim of convincing the other party of the correctness of the sworn speech. The purpose of this study is (1) to be able to determine the process of appointing witness oaths without using the Qur'an in the Garut Class IA Religious Court. (2) to know the law of taking oath of witnesses who do not use the Qur'an. In this study using the method of field research (field research), which in this type of research is qualitative research. Using data sources, namely primary data sources, is also secondary. Then in data collection using Literature Studies and also interviews. From the results of the study, it can be concluded that (1) The judge in proving the testimony is true or not is done by taking oath. In Indonesia, oaths usually use the Qur'an, but in the Garut Religious Court Class IA does not use the Qur'an, they simply say the word "Wallahi". The oath is taken before a panel of judges by following the oath taken by the judge on duty. (2) Review of Islamic Law On the use of the Qur'an as an oath it is the Law is Mubah or permissible. Because the use of the Qur'an is just a tradition that exists in courts in Indonesia. So an oath that does not use the Qur'an as is done in the Garut Class IA Religious Court is legally permissible because the assumption of the Garut Class IA Religious Court in taking the oath is sufficient to pronounce the word "Wallahi" without using the Qur'an oath tool.
