Abstract

ABSTRACT Crime is a social phenomenon that is always faced by every society. When someone understands that they are serving a sentence handed down by a court, their rights as a citizen will be limited in their movement because they are placed in a correctional institution. But there are still restoration rights that must be protected in the Indonesian correctional system. Prisoners or inmates have the right to obtain their rights without any discrimination between other correctional inmates in providing their rights. This condition of course has an influence on the provision of rights implemented by a correctional institution. So what if one of these rights is not received by compensation, what efforts will the Palembang Class II A Women’s Prison make to fulfill the donor's rights based on Islamic Law and Law no. 22 of 2022 concerning Corrections. This research is field research (field research) located in the Class II A Palembang Women's Prison. The data collection methods in this research are through interviews, documentation and literature study. Primary data was obtained from interviews with officials at the Palembang Class II A Women's Prison and 10 female employees at the Palembang Class II A Women's Prison. Secondary data was obtained from the Al-Qur'an, library books, legal dictionaries, scientific writings and statutory regulations related to this research. After the data obtained, the researcher analyzed it using qualitative descriptive analysis. The research results show that first, the efforts made by the Palembang Class II A Women's Penitentiary to fulfill the rights of prisoners include providing health services, decent food, information services and legal aid, family visit services, social services, worship services, complaint services. , education and teaching services, and literacy services. There are only a few prisoners' rights that have not been fulfilled, such as the right to receive physical care. In the efforts of the Palembang Class II A Women's Prison to fulfill the rights of inmates to receive physical care in terms of water, the prison officers have made efforts to create a water reservoir to accommodate water from PDAM and distribute it equally to the inmates by giving each person one bucket of water. Second, the efforts made by the Class II A Palembang Women's Penitentiary to fulfill the rights of prisoners are in accordance with Islamic law. congregational prayer. Although some rights have not been fully fulfilled due to overcapacity and lack of water rations, this affects the quality of a Muslim in praying. Third, Law no. 22 of 2022 concerning Corrections is in line with the values of Islamic law regarding the concept of Maqashid Al-Syari'ah towards protecting the rights of prisoners. The rights of convicts regulated in Law Number 22 of 2022 concerning Corrections are still incomplete. Officials at the Palembang Class II A Women's Penitentiary have fulfilled the rights of prisoners, but there are only a few obstacles such as overcapacity, lack of water rations, and the need for additional prison guard officers.
