Abstract

Mahar adalah pemberian wajib dari calon suami kepada calon istri yang diberikan dengan penuh kerelaan. Mahar tidak memiliki batasan minimal dan maksimal sehingga mahar termasuk kepada syarat sahnya pernikahan dan bukan bagian dari rukun nikah. Seiring berjalannya waktu bentuk mahar banyak mengalami perubahan mengikuti tren perkembangan zaman sehingga sekarang banyak pasangan menikah menggunakan mahar unik bahkan anti mainstream contohnya ada pasangan yang menikah dengan bitcoin, ular sanca, sandal jepit, dua tusuk sate dan lain sebagainya. Permasalahan yang diteliti dalam skripsi ini adalah bagaimana pandangan Kepala Kantor Urusan Agama (KUA) di Kota Prabumulih terhadap fenomena perubahan bentuk mahar yang terjadi saat ini dan bagaimana tinjauan Hukum Islam terhadap fenomena perubahan bentuk mahar yang terjadi saat ini. Jenis penelitian yang digunakan dalam skripsi ini adalah jenis penelitian lapangan (field research) dengan pendekatan fenomenologi dengan data primer berupa hasil wawancra kepada enam orang Kepala KUA di Kota Prabumulih. Penelitian ini menghasilkan Pandangan Kepala Kantor Urusan Agama (KUA) terhadap fenomena perubahan bentuk mahar yang terjadi saat ini. Dari hasil wawancara dengan enam narasumber dapat disimpulkan bahwa fenomena perubahan bentuk mahar yang terjadi saat ini merupakan hal yang sangat wajar karena memang mahar tidak memiliki batasan sehingga setiap orang bebas memilih mahar apa saja asalkan tidak bertentangan dengan Hukum Islam dan Hukum Negara. Kata Kunci: Mahar, Kantor Urusan Agama dan Pandangan Hukum Islam. ABSTRACT Dowry is an obligatory gift from the prospective husband to the prospective wife given willingly. The dowry has no minimum and maximum limits so that the dowry is included in the conditions for the validity of marriage and is not part of the pillars of marriage. Over time, the form of dowry has changed a lot following the trend of the times so that now many married couples use unique and even anti-mainstream dowries, for example there are couples who marry with bitcoins, pythons, flip flops, two skewers and so on. The problem studied in this thesis is how the views of the Head of the Religious Affairs Office (KUA) in Prabumulih City on the phenomenon of changes in the form of dowry that occurs today and how Islamic Law reviews the phenomenon of changes in the form of dowry that occurs today. The type of research used in this thesis is field research with a phenomenological approach with primary data in the form of interviews with six heads of KUA in Prabumulih City. This research results in the views of the Head of the Religious Affairs Office (KUA) on the phenomenon of changes in the form of dowry that occur today. From the results of interviews with six informants, it can be concluded that the phenomenon of changing the form of dowry that occurs today is a very natural thing because dowry does not have restrictions so that everyone is free to choose any dowry as long as it does not conflict with Islamic Law and State Law
