Abstract
ABSTRAK Penelitian ini mengkaji fenomena yang berkaitan dengan perubahan kebijakan peraturan bupati yang dinaikkan menjadi peraturan daerah serta aktor-aktor politik yang terlibat dalam proses perumusan perubahan kebijakan yang telah disebutkan sebelumnya. Tulisan ini menguraikan dan mendiskusikan bagaimana proses perubahan kebijakan peraturan bupati yang dinaikkan menjadi peraturan daerah dan keterlibatan aktor-aktor perumusan kebijakan terkait dalam proses terjadinya perubahan kebijakan peraturan bupati yang dinaikkan menjadi peraturan daerah yang berkaitan dengan upaya dalam melaksanakan pola kehidupan masyarakat yang terjamin kesehatannya, kedisiplinannya dan produktifitasnya di masa kebiasaan baru Covid-19 pada Kabupaten Musi Banyuasin. Metode yang dimanfaatkan pada kajian ini yakni metode kualitatif dengan menganalisis, menyelidiki, memahami dan meneliti suatu masalah telah terjadi dengan tujuan untuk memberikan gambaran mendalam dengan permasalahan objek penelitian. Pengumpulan data dalam penelitian ini menggunakan metode wawancara dan dokumentasi. Hasil penelitian ini menunjukkan bahwa faktor yang melatarbelakangi terjadinya perubahan kebijakan perubahan kebijakan peraturan bupati yang dinaikkan menjadi peraturan daerah yang berkaitan dengan upaya dalam melaksanakan pola kehidupan masyarakat yang terjamin kesehatannya, kedisiplinannya dan produktifitasnya di masa kebiasaan baru Covid-19 pada Kabupaten Musi Banyuasin karena adana kaitan dengan ketentuan hukum sebelumnya dalam peraturan bupati tersebut terdapat sanksi denda, padahal sanksi denda hanya dapat dimuat dalam produk hukum peraturan daerah. Faktor selanjutnya karena adanya keadaan luar biasa bencana non-alam pandemi Covid-19 serta melaksanakan amanat perintah yang lebih tinggi. Dan Aktor-aktor yang berperan dalam perumusan perubahan kebijakan Peraturan Bupati Nomor 67 Tahun 2020 menjadi Peraturan Daerah Nomor 16 Tahun 2020 tentang Pelaksanaan Pola Hidup Masyarakat yang Sehat, Disiplin dan Produktif di Era Kebiasaan Baru Corona Virus Disease 2019 diklasifikasikan menjadi dua golongan, yakni Official Policy Makers atau Tim Resmi Pembuat Kebijakan seperti Anggota DPRD Kabupaten Musi Banyuasin, Bagian Hukum Sekretariat Daerah Musi Banyuasin, Bagian Persidangan dan Perundang-Undangan Sekretariat DPRD Kabupaten Musi Banyuasin, Dinas Kesehatan Musi Banyuasin, Badan Penanggulangan Bencana Daerah Musi Banyuasin, Rumah Sakit Umum Daerah Sekayu Kabupaten Musi Banyuasin dan Satgas Covid-19 Kabupaten Musi Banyuasin, erta Unofficial Participants atau Tim Tidak Resmi Pembuat Kebijakan seperti Kelompok Pakar/Tim Ahli DPRD Kabupaten Musi Banyuasin. ABSTRACT This research is about the changes in the policy of the regent’s regulations which was raised to regional regulations and the political actors involved in the process of formulating the policy change. This paper describes and discusses how the process of changing the regent's regulation policy which was raised to become a regional regulation and the involvement of related policy formulation actors in the process of changing the regent's regulation policy which was raised to a regional regulation related to efforts to implement a pattern of people’s life whose health and discipline are guaranteed and productivity during the new Covid-19 habit in Musi Banyuasin Regency. The method used in this study is a qualitative method by analyzing, investigating, understanding and researching a problem that has occurred with the aim of providing an in-depth picture of the problem object of research. Collecting data in this study utilizes interviews and documentation methods. The results of this study indicate that the factors behind the change in the policy changes to the regent's regulation which was raised to become a regional regulation related to efforts to implement a pattern of people’s life whose health and discipline are guaranteed and productivity during the new Covid-19 in Musi Banyuasin Regency because there is a connection with the previous legal provisions in the regent's regulation there is a fine, even though the fine can only be contained in the legal product of the regional regulation. The next factor is due to the extraordinary circumstances of the Covid-19 pandemic non-natural disaster and carrying out higher orders. And the actors who played a role in the formulation of policy changes to Regent Regulation Number 67 of 2020 into Regional Regulation Number 16 of 2020 concerning the Implementation of Healthy, Disciplined and Productive Community Lifestyles in the Era of New Habits of Corona Virus Disease 2019 are classified into two groups, namely the Official Policy Makers or the Official Team of Policymakers such as Members of the Musi Banyuasin Regency DPRD, the Legal Section of the Musi Banyuasin Regional Secretariat, the Trial and Legislation Section of the Musi Banyuasin Regency DPRD Secretariat, the Musi Banyuasin Health Office, the Musi Banyuasin Regional Disaster Management Agency, Hospitals General Sekayu Region, Musi Banyuasin Regency and the Covid-19 Task Force of Musi Banyuasin Regency, as well as Unofficial Participants or Unofficial Policy-Making Teams such as the Expert Group/Expert Team of the Musi Banyuasin Regency DPRD.
