Abstract
Mediation is a peaceful effort caried, outby both partis,to the litigations with te help of ajudge as a third party, the focus of this research is on thee effectivenes. of mediations in the settlements off civil case in the, Religions Courts Class 1A Palembang and the District Courts Class 1A Palembang. Thi’s studi also aim (1) too determinen the in hibiting factors and supporting factors for these implementations off mediations in the settlement off civil case in the Religiouss Court Class 1A Palembang and the District Courts Class 1A Palembang. (2) too finde out the reals effectiveness off mediations in the settlemenst off civil cases in the Religious Courts Class 1A Palembang and the District Courts Class 1A Palembang. The typee off research useed in thi’s studi is field research using a qualitativ approachs too the object discussed in accordance with the reality that occurred in the Class 1A Palembang Religious Courts and the Palembang Class 1A District Courts. The data use in thi’s studies areprimary data and second datta. The resultss ofthe research and discussion carried out by researchers can be concluded that thee effectivenss of mediations in the settlements off civil case that occur inthe Religiouse Courts Class 1A Palembang and the Class 1A Palembang District Courts is still less effective when viewed from the results, because the success rate of mediation is still low which results in an agreement decision for peace. However, from a legal and procedural perspective, mediation at the Religious Courts Class 1A Palembang and the District Courts Class 1A Palembang has been effective. Because the mediator judge has optimized the mediations process by making every effort possible toarchieve apeace agreements beweens thi two parties.
