Abstract
The title of this thesis is the application of dwangsom in hadhanah cases (analysis study of the judge's decision of the Pasuruan religious court number 0376 / pdt.g / 2015 / pa.pas). dwangsom is an amount of money stipulated in a judge's decision that must be paid by the defendant for the benefit of the opposing party if he does not fulfill the basic sentence, or in other words as forced money. In the case of hadhanah, the application of dwangsom is still a matter of debate among legal practitioners themselves. However, the application of dwangsom in the execution of hadanah is not as easy as imagined because it requires complicated requirements and a strong commitment from judges, including that: dwangsom must have reasons for its strong urgency, especially if there is no request from the plaintiff; dwangsom must be imposed together with the basic sentence; the principal penalty is not payment of an amount of money; and the defendant / convict is able to carry out the basic sentence. Forced execution in the case of hadanah is something that is impossible because it contradicts the just and civilized human principles and the mission of hifdhul nafsi and hifdhul nasl (protecting souls and descendants) in Islamic sharia.
